Getting Past the Emotions of a Prenuptial Agreement

If you are getting married, plan to live in the state of Florida and are considering a prenuptial agreement, you will need to confront the emotional as well as the legal aspect of such an agreement. It is best that you do this well in advance of the wedding date, to avoid legal challenges to the agreement as well as emotional upheaval. Here are a few things to consider:

  • Marriage is a legal contract. If you approach it this way, even though it is not very romantic, you can see past any negativity.

 

  • Talk about the prenup with your fiancé. Let him or her know why it is important to you to have one, or not to have one. Communication is key in this situation as well as through the course of your marriage. Yes, it can be awkward since you are looking forward to your wedding and that is supposed to be a romantic, happy time for you and your fiancé. But, like anything in your marriage, if this is important to you, you need to talk about it.

 

  • Try not to dwell on the prenuptial agreement after the marriage. While you may need to, or agree to make changes in the future, or you may need to sign a postnuptial agreement (both of which should be thoroughly explained to you by an attorney), continually keeping it present in your life will only create tension in the marriage. When it is signed and complete, lock it away somewhere safe in the hopes that you will never have to use it. But, if your marriage does not last, having this document may save you a lot of headaches, and money.

 

  • Do not rush the process. Some people might hurry through the paperwork, or not provide the required financial information, to either keep it simple or because it is an uncomfortable topic. Others might not think to mention certain items to their attorney to include in the document due to rushing through it. And you might be tempted to just sign the agreement to get it over with or avoid any awkward discussions. None of these are a good idea when signing an agreement of such legal importance, nor are they a good start to a long and happy marriage.
